1. Agreement to Terms

This Terms of Use Agreement (“Agreement”) is a legal agreement between you (“User,” “you,” or “your”) and RageQuit.gg, its operators, owners, and affiliates (collectively, “we,” “us,” or “our”) governing your access to and use of the website located at https://ragequit.gg, including all subdomains, subpages, and associated services (collectively, the “Site”).

By accessing or using the Site in any manner, whether by browsing, contributing content, registering an account, or otherwise, you acknowledge that you have read, understood, and agree to be bound by this Agreement and our Privacy Policy, which is incorporated herein by reference.

All content on the Site, including but not limited to editorial articles, reviews, guides, walkthroughs, wiki entries, videos, graphics, logos, icons, HTML, CSS, software, and the overall look and feel of the Site, is owned by or licensed to RageQuit.gg and is protected by applicable copyright, trademark, trade dress, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and view the Site’s content for your personal, non-commercial use only. RageQuit.gg does not claim ownership over any third-party intellectual property. RageQuit.gg is an independent publication and is not affiliated with, endorsed by, or sponsored by any game developer, publisher, or platform holder unless explicitly stated.

4.3 User-Submitted Content

By submitting, posting, or otherwise making available any content on the Site, including comments, tips, corrections, edits, or forum posts (collectively, “User Content”), you hereby grant RageQuit.gg a perpetual, irrevocable, non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in any media, now known or hereafter developed.

You represent and warrant that:

You own, or have sufficient rights to, all User Content you submit;
Your User Content does not infringe upon the intellectual property, privacy, or other rights of any third party;
Your User Content does not contain defamatory, fraudulent, obscene, or otherwise unlawful material.

We are not obligated to maintain, display, or make available any User Content, and we reserve the right to remove any User Content at our sole discretion and without notice.

5. Acceptable Use Policy

You agree that you will not use the Site to:

Violate any applicable local, national, or international law or regulation;
Post, transmit, or distribute content that is unlawful, harassing, defamatory, abusive, threatening, vulgar, obscene, or otherwise objectionable;

RageQuit.gg publishes game guides, wikis, walkthroughs, and editorial content as a convenience to users. Game content changes frequently due to developer patches, updates, balance changes, downloadable content, and expansion releases. We do not warrant that any information on the Site is current, accurate, complete, or fit for any particular purpose.

6.2 Disclaimer of Warranties

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RAGEQUIT.GG AND ITS OWNERS, OPERATORS, CONTRIBUTORS, AUTHORS, EDITORS, OFFICERS, AND AGENTS (COLLECTIVELY, “RELEASED PARTIES”) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING OUT OF OR RELATED TO:

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED ONE HUNDRED UNITED STATES DOLLARS (USD $100.00).

8. Indemnification

You agree to defend, indemnify, and hold harmless RageQuit.gg and the Released Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:

Your violation of any provision of this Agreement;
Your violation of any applicable law or regulation;
Your violation of any rights of a third party, including intellectual property rights or privacy rights;
Any User Content you submit, post, or transmit through the Site.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate fully with our defense of any such claim.

13. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with applicable law, without regard to its conflict of law provisions. The parties agree to first attempt to resolve any dispute arising from or relating to this Agreement through good-faith written negotiation. If a dispute cannot be resolved through negotiation within thirty (30) days of written notice, either party may pursue formal legal proceedings.

To the extent permitted by law, you hereby waive any right to participate in any class-action lawsuit or class-wide arbitration against RageQuit.gg or any of the Released Parties.

If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The failure of RageQuit.gg to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision.

14. Termination

We may suspend or terminate your access to the Site or any portion thereof, with or without notice, for any reason or no reason, including without limitation if we reasonably believe you have violated this Agreement. Upon termination, all provisions of this Agreement that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.

You may discontinue your use of the Site at any time. If you have registered an account, you may request deletion of your account by contacting us at [email protected].

15. Modifications to the Site and Terms

We reserve the right to modify, suspend, or discontinue the Site, or any part thereof, at any time and without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

We will provide notice of material changes to this Agreement by updating the “Last Updated” date at the top of this page and, where appropriate, by posting a prominent notice on the Site. Your continued use of the Site following such notice constitutes your acceptance of the updated Agreement.

16. Entire Agreement and Severability

This Agreement, together with our Privacy Policy and any other legal notices or policies published by us on the Site, constitutes the entire agreement between you and RageQuit.gg with respect to your use of the Site and supersedes all prior agreements, understandings, and communications, whether written or oral, relating to such subject matter.

If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
